State collectable laws and Casinos

I'm in the process of trying to get Tennessee Code changed to allow ownership of vintage, 25 year old and older, gaming devices.

A gentleman showed up at the last committee meeting expressing concerns that a casino could use our "collectable clause" to open a vintage slot machine "museum" with the machines set on token play and allow people to play them. Once established, they could then raise the argument that the state is allowing them to play on tokens, why not allow a regular casino to open. Tennessee doesn't allow casinos to operate in the state yet, but I feel that may be changing.

I've never heard of something like this happening before. Has anyone ever heard of something like this happening anywhere else, specifically using our collectable clause as a toe hold to get casinos in the state.

I haven't seen the text of your proposed law, but ...

1) If the text says home use, or private ownership, then ask this dude how his scenario fits there?

2) Gamblers are not going to play for tokens unless those tokens represent value. I suspect your state anti-gambling laws already deals with that.

3) It appears that redemption machines are already outlawed in Tennessee, so there couldn't be a "museum" operating with machines that offer tokens (tokens are the same as redemption tickets).

I could go on and on ... but I don't know if you already have a draft law that you are working from, or this is just testing the waters at this point, so I really have no idea how to dispute this gentleman's objections.

Another freaking idiot.

Ask him to provide an example of any other state which allows slots to be collected and a casino is doing this. For example, Utah is wide open when it comes to collecting slots yet no such casinos have emerged there.

Also, as others have pointed out, if the tokens played have any value then the existing gambling / lottery laws would go into effect.

Dear Ric:

I handled the Antique Slot law when it was adopted in LA, and I can send you a copy thereof if you wish. We have a "rolling" 25 year law. No one ever raised this question. However, you might want to clarify that the use of antique slots for gambling purposes remains illegal. That way any antique slot utilized as you described would continue to be classified as a gambling device and therefore illegal. In essence, your proposed law is an exemption to an anti-gambling law. Guys,

Thank you very much for your input. Walter, good suggestions. I'll go back and see if our wording includes home use or private ownership.

This is our second attempt to get this bill passed and TN Code changed. Last year my bill was doing great, with no opposition, and then Covid came along and my bill got tabled.
We're having to start over at the beginning and run through all the committees this year.

I'll keep you posted.

As info........It is legal to own antique slot machines in North Carolina, and the state also has casinos.
